PLEASE READ THESE TERMS CAREFULLY. BY ACCESSING OR USING THE PLATFORM, YOU ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTOOD, AND AGREE TO BE BOUND BY THESE TERMS OF SERVICE AND OUR PRIVACY POLICY.

1. Introduction

These Terms of Service ("Terms") constitute a legally binding agreement between you ("User", "Customer", "you") and Get Your Roman Tours S.R.L.S, a company incorporated under Italian law, with registered office at Via Tre Novembre 40, Mentana (RM), CAP 00013, Italy, Company Licence / VAT No. IT18457421008, PEC: getyourromantourssrls@pec.it ("Company", "we", "us", "our").

These Terms govern your access to and use of our online marketplace and booking platform at www.getromantours.com, our mobile applications, and all related services (collectively, the "Platform"). By creating an account, browsing, or completing a booking, you agree to these Terms in their entirety.

We reserve the right to update these Terms at any time. Material changes will be communicated by email to registered users and/or by prominent notice on the Platform no less than 14 days before the change takes effect. Your continued use of the Platform following the effective date of any change constitutes your acceptance of the revised Terms.

2. About the Platform

Get Your Roman Tours S.R.L.S operates a global online marketplace that connects travellers ("Customers") with tour operators, local guides, and activity providers ("Suppliers") offering tours, experiences, transfers, day trips, skip-the-line tickets, cultural activities, food and wine experiences, outdoor adventures, multi-day tours, and all manner of travel activities worldwide (collectively, "Experiences" or "Services").

The Platform functions in two capacities:

Direct Provider: In certain circumstances, Get Your Roman Tours S.R.L.S acts directly as the licensed tour operator and is responsible for the Experience you purchase.
Marketplace Intermediary: In other cases, we operate as a technology platform that facilitates transactions between you and independent Suppliers. In this capacity, the Supplier is directly responsible for the quality, delivery, and legality of the Experience. The contract for the Experience is between you and the Supplier; we act as agent on behalf of the Supplier for the purposes of accepting payment.

The applicable capacity for each Experience is clearly indicated on the relevant Experience listing page.

3. Account Registration and Security

3.1 Creating Your Account

You may browse the Platform as a guest; however, to complete a booking you must create an account. When registering, you agree to:

Provide truthful, accurate, and complete personal information including your full legal name, email address, and phone number.
Keep your account information updated at all times.
Maintain the confidentiality of your password and restrict access to your account.
Accept full responsibility for all activity that occurs under your account.
Notify us immediately at info@getromantours.com if you suspect any unauthorised use of your account.

We may refuse account registration, suspend, or permanently close accounts at our sole discretion, including where we suspect misuse, fraud, or violation of these Terms.

3.2 Eligibility

You must be at least 18 years old to register. By creating an account you confirm that you meet this requirement. If you are booking on behalf of a company or organisation, you confirm that you have authority to bind that entity to these Terms.

4. Booking Process

4.1 Making a Booking

When you select an Experience and proceed to checkout, you are making an offer to purchase that Experience at the price and under the conditions displayed. A legally binding booking is formed only when you receive a written Booking Confirmation from us. We reserve the right to decline any booking at our discretion without obligation to provide a reason.

Your Booking Confirmation will set out all material details of your booking: the Experience description, date and time, meeting point, number of participants, itemised pricing, payment summary, and the applicable cancellation policy.

4.2 Pricing and Currency

All prices are displayed in the currency selected on the Platform and represent the total cost inclusive of applicable service fees, unless otherwise stated at checkout. Local taxes, national entry fees, and optional extras will be clearly shown before final payment. Prices are dynamic and subject to change; however, once your booking is confirmed, the price is locked.

In the event of a manifest pricing error on the Platform, we reserve the right to cancel the booking and issue a full refund, or offer you the corrected price with the option to decline and receive a full refund.

4.3 Payment

We accept major credit and debit cards (Visa, Mastercard, American Express), PayPal, and other payment methods as displayed at checkout. All payments are processed by PCI-DSS compliant third-party payment processors. We do not store full card details on our servers. Payment is debited at the time of booking confirmation.

4.4 Booking Modifications

Requests to modify a confirmed booking (change of date, number of participants, etc.) are subject to availability and the Supplier's modification policy. Contact us at bookings@getromantours.com or via your account dashboard as soon as possible. If a modification results in a price difference, the balance will be charged to or refunded to your original payment method. If the requested modification cannot be accommodated, your original booking remains valid.

5. Customer Responsibilities

When booking and participating in an Experience, you agree to:

Provide complete and accurate booking information including participant details, dietary requirements, accessibility needs, and any relevant medical information.
Arrive at the designated meeting point at the specified time. Late arrival may result in forfeiture of your booking without refund at the Supplier's discretion.
Follow all safety instructions and guidelines provided by the Supplier and/or guides at all times.
Behave respectfully and considerately towards guides, other participants, local communities, and cultural sites.
Ensure all participants in your group meet any specified age, health, or fitness requirements.
Obtain adequate travel and health insurance prior to travel.
Ensure you hold all necessary travel documents (passports, visas, etc.) for your destination.

We and our Suppliers reserve the right to exclude any participant from an Experience at any time on grounds of safety, health, intoxication, disruptive behaviour, or failure to meet stated requirements. No refund is due in such circumstances.

6. Prohibited Conduct

When using the Platform, you must not:

Use the Platform for any unlawful purpose or in any manner that violates applicable law.
Attempt to gain unauthorised access to any part of the Platform, its servers, or connected systems.
Use automated tools, bots, or scrapers to access, collect data from, or interact with the Platform.
Submit false, misleading, or fraudulent information, bookings, or payment details.
Post reviews, ratings, or content that is defamatory, fraudulent, offensive, or harassing.
Reproduce, sell, or exploit Platform content without our express written permission.
Book Experiences with intent to resell them without prior written authorisation.
Transmit viruses, malware, or any code designed to disrupt, damage, or limit functionality.
Attempt to circumvent security, authentication, or fraud-prevention measures.

7. Reviews and User-Generated Content

Customers who have completed an Experience may submit a review and rating through the Platform. Reviews must be honest, first-hand, and based solely on your personal experience. We reserve the right to moderate, edit, or remove reviews that contain offensive language, defamatory statements, commercial promotions, or that were not submitted by genuine participants. By submitting a review or any other content, you grant us a worldwide, royalty-free, perpetual licence to use, display, reproduce, and adapt such content for Platform and marketing purposes.

8. Intellectual Property

All content on the Platform — including but not limited to text, graphics, logos, photographs, video, software, data compilations, and design — is the property of Get Your Roman Tours S.R.L.S or its content licensors and is protected by Italian and international intellectual property law. You may not reproduce, modify, distribute, or commercialise any Platform content without our prior written consent. The Get Your Roman Tours S.R.L.S name, logo, and related trademarks are registered and may not be used without authorisation.

9. Third-Party Services

The Platform integrates and links to third-party services including payment processors, mapping providers, translation tools, identity verification services, and analytics platforms. These third parties operate under their own terms and privacy policies. We are not responsible for the content, accuracy, availability, or practices of any third-party service.

10. Disclaimers

THE PLATFORM AND ALL CONTENT, PRODUCTS, AND SERVICES AVAILABLE THROUGH IT ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. TO THE FULLEST EXTENT PERMISSIBLE UNDER APPLICABLE LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE PLATFORM WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE FROM HARMFUL COMPONENTS.

WHERE WE ACT AS A MARKETPLACE INTERMEDIARY, WE ARE NOT RESPONSIBLE FOR THE QUALITY, SAFETY, ACCURACY, OR LEGALITY OF EXPERIENCES PROVIDED BY SUPPLIERS. EXPERIENCES ARE DELIVERED BY INDEPENDENT THIRD PARTIES OVER WHOM GET YOUR ROMAN TOURS S.R.L.S HAS NO DIRECT OPERATIONAL CONTROL.

11. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, GET YOUR ROMAN TOURS S.R.L.S AND ITS DIRECTORS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, GOODWILL, OR PERSONAL INJURY, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE PLATFORM OR ANY EXPERIENCE.

WHERE WE ACT AS MARKETPLACE INTERMEDIARY, OUR TOTAL AGGREGATE LIABILITY IN CONNECTION WITH ANY BOOKING SHALL NOT EXCEED THE TOTAL AMOUNT PAID BY YOU FOR THAT SPECIFIC BOOKING.

Nothing in these Terms limits or excludes any liability that cannot be limited or excluded under applicable law, including liability for death or personal injury caused by negligence, fraud, or fraudulent misrepresentation.

12. Indemnification

You agree to indemnify, defend, and hold harmless Get Your Roman Tours S.R.L.S and its officers, directors, employees, contractors, agents, and affiliates from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising from: (i) your use of the Platform in violation of these Terms; (ii) your User Content; (iii) your violation of any applicable law; or (iv) any claim by a third party arising from your use of the Platform.

13. Governing Law and Dispute Resolution

These Terms are governed by and construed in accordance with the laws of Italy. Any disputes arising from or in connection with these Terms shall be subject to the non-exclusive jurisdiction of the courts of Rome, Italy. Consumers resident in the European Union may bring proceedings before the courts of their country of habitual residence.

Prior to commencing formal legal proceedings, we encourage you to contact us at legal@getromantours.com to attempt an amicable resolution. EU consumers may also access the Online Dispute Resolution (ODR) platform of the European Commission at https://ec.europa.eu/consumers/odr.
